Acceptable Use Policy
This Acceptable Use Policy ("AUP") sets out what you may and may not do with MorphMe Live. It mirrors and incorporates the Decart Lucy 2 Acceptable Use Policy because MorphMe Live transmits your input to Decart for AI processing. A violation of Decart's AUP is also a violation of this AUP and our Terms of Service.
If you cannot or will not comply with this AUP, do not use MorphMe Live.
1. What MorphMe Live Is For
MorphMe Live is a desktop streaming tool. The intended use is to transform your own appearance into a fictional character in real time while you stream on Twitch, YouTube, Kick, or any platform that captures OBS. Permitted use cases include:
- Streaming as an anime, game, original, or fictional character you have the right to use
- VTubing without rigged avatars
- Privacy: appearing on camera without showing your real face
- Creative, entertainment, and educational content where any real person depicted has given documented consent
2. Real-Person Likeness — Consent Required
The largest single risk with character-swap AI is impersonating a real person. You must not:
- Use the face, body, voice, or identity of any real, identifiable person — living or deceased — without that person's explicit, informed, documented written consent.
- Stream as a public figure, politician, celebrity, or any individual in a way likely to mislead viewers.
- Create content intended to deceive any viewer about who the speaker actually is.
You attest each time you upload a reference image that either (a) the image depicts a fictional character, or (b) you have verifiable consent from the real person it depicts. We may require you to produce that consent if there is a complaint.
3. Disclose AI Use to Your Viewers
You must conspicuously disclose to your viewers that the content is AI-generated, in line with the rules of the platform you are streaming on and the law of the jurisdictions where your content can be seen. At minimum:
- Include "AI character / using MorphMe Live" or similar in your stream title or panels.
- Do not present AI-generated content as authentic news, real events, or testimony of a real person.
- Do not remove, alter, or interfere with any watermark, metadata, or provenance marker present in the output.
4. Absolutely Prohibited Uses
You must not use MorphMe Live for any of the following. These are non-negotiable and any violation results in immediate termination, forfeiture of credits, a permanent ban, and reporting to law enforcement where applicable.
A. Minors
- Generate, transmit, or store any content sexualizing a minor, in any form, AI-generated or otherwise. This includes content that depicts an apparent minor in a sexual or suggestive context.
- Stream as a minor for the purpose of grooming, soliciting, or interacting inappropriately with other minors.
- Use the app if you are under 18 years old.
B. Non-consensual intimate content
- Produce any sexual, sexually suggestive, pornographic, or intimate content depicting an identifiable real person without that person's explicit written consent.
C. Harassment, defamation, threats
- Produce content designed to bully, harass, stalk, defame, intimidate, or threaten any individual or group.
- Promote violence, hatred, or discrimination on any protected-class basis.
D. Fraud and deception
- Romance scams, identity theft, business-email compromise, job-interview fraud, or any financial fraud.
- Manipulating financial markets.
- Creating false evidence, fake confessions, or fabricated witness statements.
- Influencing elections through impersonation of candidates, officials, or voters.
E. Illegal content and high-risk uses
- Terrorism, incitement to violence, hate speech, glorification of violence.
- Malware, viruses, or circumvention of security measures.
- Any of the EU AI Act's "unacceptable risk" or "high risk" use cases (real-time biometric ID, social scoring, emotion inference for workplace/education, criminal-risk profiling, untargeted biometric scraping, autonomous weapons, medical diagnosis).
- Any use that violates applicable law in any jurisdiction where the content may be viewed.
F. Intellectual property infringement
- Streaming as a copyrighted character in a way that would constitute infringement or violate the right of publicity.
- Producing content that could reasonably be mistaken for the work of another artist, brand, or media organization.
G. Service abuse
- Sharing, renting, reselling, sublicensing, or transferring your account or credits.
- Reverse-engineering, decompiling, or disassembling MorphMe Live.
- Bots, scripts, or automation against the credit or auth systems.
- Bypassing credit deduction, rate limiting, or any security control.
- Removing or stripping watermarks, metadata, or provenance markers from any output.
5. Content Moderation and Reporting
We do not pre-screen real-time stream content — that is technically impossible at the latency MorphMe Live operates at. We rely on:
- This AUP and the consent attestation gate in the app.
- Reports from rights-holders, viewers, and platforms.
- Decart's own moderation on the API side.
- Account-level enforcement when we receive credible reports.
If you encounter content created with MorphMe Live that violates this AUP, please report it to hello@morphmelive.com with the subject line REPORT — [copyright / likeness / NCII / minor / fraud / other]. We acknowledge valid reports within 14 days and act in good faith.
6. Cooperation with Decart and Law Enforcement
We cooperate with Decart, regulators, and law enforcement on valid legal process. We may disclose your identity, transaction records, session metadata, and any other data we hold, and we may preserve records prior to or in the absence of formal process if we receive a credible complaint of a serious violation.
7. Enforcement
- First-time minor violations: warning, education, account note.
- Repeated or serious violations: account suspension, credit forfeiture, permanent ban.
- Illegal content (CSAM, NCII, fraud, election interference, malware): immediate ban, evidence preservation, report to NCMEC / NDPC / relevant authorities, recovery of legal costs.
8. How MorphMe Live Meets Decart's AUP
The table below maps each clause of the Decart Lucy 2 Acceptable Use Policy to the specific MorphMe Live surface that implements it. We publish this for transparency — anyone, including Decart's review team, should be able to verify our compliance in minutes rather than reading the entire codebase.
| Decart AUP clause | MorphMe Live implementation | Where to verify |
|---|---|---|
| Real-person likeness — verifiable consent required | Upload Consent Modal: first reference image triggers a three-checkbox attestation (fictional or consented likeness, AI disclosure to viewers, AUP acknowledgement). Persistent inline reminder strip on every subsequent upload. | App → Workshop → Upload tab (first upload) and below the dropzone (every upload) |
| AI-generated content disclosure | Stream Kit: three styles (Minimal, Playful, Pro) × three platforms (Twitch title, Twitch/Kick panel HTML, YouTube description) with disclosure language baked into every variant. One-click copy. | App → Settings → Stream → Stream Kit |
| Content moderation appropriate to product and audience | Structured /report form with platform URL, violation type, streamer handle, and timestamps. 14-day acknowledgment SLA. Enforcement ladder published in our AUP §7 (warning → suspension → forfeiture → ban → law enforcement referral). | morphmelive.com/report |
| Watermark / metadata not to be stripped | AUP §4.G + Terms §6.2.E explicitly forbid users from removing, altering, or interfering with watermarks, metadata, or provenance markers in any output. | This page §4.G + /terms §6.2.E |
| Sub-processor disclosure to end users | Privacy Policy §5 names Decart explicitly as the AI sub-processor, with full data-flow description, retention policy, and link to Decart's own privacy policy. | morphmelive.com/privacy §5 |
| Age gate (13+ global, 16+ EEA, parental consent 13–18) | Terms §3 sets a single global minimum age of 18 years — stricter than the Decart AUP baseline. Misrepresenting age voids the licence and triggers Section 14 indemnification. | /terms §3 |
| EU AI Act "unacceptable risk" and "high risk" use prohibition | AUP §4.E lists the full EU AI Act prohibited-use catalogue (real-time biometric ID, social scoring, emotion inference, criminal-risk profiling, untargeted biometric scraping, autonomous weapons, medical diagnosis). | This page §4.E |
| Deepfake / impersonation without consent — prohibited | AUP §4.A forbids non-consensual likenesses; AUP §2 requires verifiable consent for any real-person reference image; the Upload Consent Modal makes the user attest to this on first upload. | This page §2 + §4.A; App Upload tab |
| CSAM / sexualizing minors — absolutely prohibited | AUP §4.A explicitly prohibits all such content, AI-generated or otherwise, with mandatory NCMEC reporting referenced in §6. | This page §4.A + §6 |
| Misinformation / election interference / financial fraud | AUP §4.D prohibits romance scams, identity theft, BEC, job-interview fraud, false evidence, election deepfakes, market manipulation. | This page §4.D |
| Acceptable Use Policy — published & mirrored for downstream users | This page (publicly indexed, linked from footer, terms, in-app Settings, in-app AuthScreen, and the upload consent modal). | You're reading it |
| Reporting mechanism visible to end users | Footer link on every page → /report structured form. In-app HelpDrawer carries a "Spotted misuse?" card with Report Content + Read AUP buttons. Subject-line prefix routes reports to a separate triage stream. | morphmelive.com/report + App → Settings → Help & FAQ |
| Cooperation with law enforcement & regulators | AUP §6 commits to cooperating with valid legal process, preserving records on credible complaint, and Section 14 indemnification by user for any regulatory enforcement triggered by their content. | This page §6; /terms §14 |
| Distributor-tier obligation to gate prohibited use | Pricing is per-second-credit, not subscription — bulk content abuse is economically self-limiting. Combined with the consent gate, AI disclosure templates, and enforcement ladder, the structural and policy controls compound. | /pricing + this page |
