MorphMe Terms of Service
⚠️ IMPORTANT — READ THIS BEFORE USING MORPHME
MorphMe can generate realistic synthetic video that resembles a real person. This technology is commonly referred to as a "deepfake." You are solely and exclusively responsible for all content you produce using MorphMe, including obtaining any consent required from third parties whose likeness you depict.
MorphMe is provided AS IS with NO WARRANTY. By using MorphMe you waive any claim against THE TOOLS HUB for damages arising from your or any other user's conduct. You agree to defend and indemnify THE TOOLS HUB against any third-party claim resulting from your use. See Sections 9, 12, 13, and 14.
If you do not accept these Terms, do not use MorphMe.
1. Acceptance of These Terms
By creating an account, purchasing credits, or otherwise using the MorphMe desktop application, the website morphmelive.com, or any related service (collectively, "MorphMe" or "the Service"), you ("you", "User") enter into a binding agreement with:
THE TOOLS HUB — a business name registered in the Federal Republic of Nigeria under the Corporate Affairs Commission (CAMA 2020), Business Name Registration No. 9204311, with its principal place of business in Cross River State, Nigeria ("we", "us", "our", "THE TOOLS HUB").
If you do not agree to any part of these Terms of Service ("Terms"), you must not use MorphMe. Your continued use after an update to these Terms constitutes acceptance of the updated version.
2. Description of the Service and Incorporated Third-Party Terms
2.1 Description
MorphMe is a desktop application that applies the Decart Lucy 2 artificial-intelligence model to a user-supplied webcam feed in real time. The output is a synthetic video resembling a character of the user's choice. MorphMe provides no content, likenesses, or source material itself — all inputs come from the user.
2.2 Third-party services
MorphMe relies on the following third-party services, each with its own terms you must also comply with:
- Google (authentication) — policies.google.com/terms
- Supabase (hosting / auth / database) — supabase.com/terms
- Paystack (payments — NGN cards) — paystack.com/terms
- NowPayments (payments — cryptocurrency, international) — nowpayments.io/terms-and-conditions
- Decart AI (AI model, real-time stream processing) — decart.ai/terms
2.3 Incorporation by reference
The terms and acceptable-use policies of Decart AI (the provider of the AI model that processes your webcam stream) are incorporated into these Terms by reference. By using MorphMe, you agree to comply with Decart's terms as if they were set out in full here. A breach of Decart's terms is a breach of these Terms.
2.4 Service changes
We may add, change, or remove third-party services at our discretion. We may also modify, suspend, or discontinue any part of MorphMe without notice.
3. Eligibility and Age Attestation
3.1 Age requirement
You must be at least 18 years of age to use MorphMe. No exceptions.
3.2 Age attestation
By creating an account or using MorphMe, you represent and warrant that you are 18 years of age or older.
3.3 Misrepresentation of age
Misrepresenting your age is a material breach of these Terms. It:
- voids your license to use MorphMe immediately;
- subjects you and your parent or legal guardian to the indemnification obligations in Section 14;
- entitles us to terminate your account, forfeit any remaining credits, and recover from you or your guardian any resulting loss.
3.4 Other eligibility
You must also: (a) have the legal capacity to enter a binding contract in your jurisdiction; (b) not be barred from receiving the Service under applicable law; (c) not have been previously banned by us.
We may require identity and age verification at any time.
4. Your Account
- You must sign in with a valid Google account.
- You are responsible for all activity under your account.
- Do not share your account.
- Notify us at hello@morphmelive.com if you suspect unauthorized access.
- We may suspend or terminate your account at our sole discretion for breach, fraud, or risk of liability.
5. Credits and Payments
5.1 Credit system
MorphMe is sold on a prepaid credit basis. Credits are consumed while you actively use swap mode.
5.2 Consumption rate
At present, the Decart Lucy 2 model consumes 2 credits per second of active streaming. This rate is subject to change at our discretion (or Decart's) and will be disclosed in the application. Changes do not apply retroactively to credits already consumed.
5.3 Pricing and currency
Prices are displayed in United States Dollars (USD) as a reference unit for product comparison. Customers may pay in one of the following currencies:
- Nigerian Naira (NGN) via Paystack. Customers paying in NGN are charged exclusively in NGN at our published rates. Current package prices in NGN are:
- Basic — ₦25,000 (1,000 credits)
- Starter — ₦100,000 (5,000 credits)
- Mid — ₦250,000 (10,000 credits)
- Pro — ₦950,000 (50,000 credits)
- Cryptocurrency (USDT, USDC, BTC, ETH, BNB, SOL — full list shown at checkout) via NowPayments, at the prevailing market rate quoted by NowPayments at the time of checkout.
Reference rates and package prices may change; changes do not apply retroactively to credits already purchased. USD is shown for transparency and is not the currency of payment for customers who pay in NGN.
5.4 Payment processors
NGN card payments are processed by Paystack. Cryptocurrency payments are processed by NowPayments. THE TOOLS HUB does not receive, store, or have access to your card details, bank details, or cryptocurrency private keys / seed phrases. Cryptocurrency payments are settled to our wallet by NowPayments after on-chain confirmation; we do not custody customer crypto.
5.5 Credits are non-refundable
All credit purchases are FINAL and NON-REFUNDABLE except where mandated by applicable law. Credits do not expire while your account remains in good standing.
5.6 Unused credits on termination
If your account is terminated by us for cause, unused credits are forfeited without refund.
5.7 Chargebacks
Initiating a chargeback without first contacting us is a material breach and may result in immediate termination, forfeiture of credits, a permanent ban, and recovery of chargeback fees and legal costs.
5.8 Taxes
Prices are exclusive of applicable taxes. You are responsible for any taxes arising in your own jurisdiction.
6. Acceptable Use
The full rules are published in our standalone Acceptable Use Policy, which mirrors and incorporates the Decart Lucy 2 Acceptable Use Policy. A violation of Decart's AUP is also a violation of these Terms. The headline rules are summarised below.
6.1 Permitted uses
You may use MorphMe for lawful personal, creative, entertainment, educational, and professional purposes where any real person depicted has given informed, documented consent.
6.2 Prohibited uses — you MUST NOT use MorphMe to:
A. Impersonate any real person without consent
- Use the likeness, face, voice, or identity of any real, identifiable person — living or deceased — without explicit, informed, documented written consent.
- Create content intended to deceive any viewer about the identity of the speaker.
- Pose as a public figure, politician, celebrity, or any individual in a way likely to mislead.
B. Create non-consensual sexual or intimate content
- Produce any sexual, sexually suggestive, pornographic, or intimate content depicting any identifiable real person without that person's explicit written consent.
- Produce any such content depicting a minor under any circumstance — this is absolutely prohibited.
C. Harass, defame, stalk, or threaten
- Produce content designed to bully, harass, stalk, defame, intimidate, or threaten any individual or group.
- Promote violence, hatred, or discrimination.
D. Commit fraud, scams, or deception
- Use MorphMe in romance scams, pig-butchering, identity theft, business-email compromise, job-interview fraud, or any financial fraud.
- Create false evidence.
- Deceive election officials or voters; create content designed to influence elections through impersonation.
- Create content intended to manipulate financial markets.
E. Evade detection or disclosure
- Circumvent any platform's policy requiring disclosure of AI-generated content.
- Remove, alter, or tamper with any watermark, metadata, or provenance marker.
- Evade content-moderation systems.
F. Violate intellectual property or publicity rights
- Infringe copyright, trademark, trade secret, or right of publicity.
- Produce content that could reasonably be mistaken for the work of another artist, brand, or media organization.
G. Abuse the Service
- Share, rent, resell, sublicense, or transfer your account, credits, or access.
- Reverse-engineer, decompile, or disassemble MorphMe.
- Use bots, scripts, or automation.
- Bypass credit deduction, rate limiting, authentication, or any security control.
- Probe or test system vulnerabilities without prior written permission.
- Introduce viruses or malware.
H. Violate applicable law
All uses that violate applicable law are prohibited, worldwide.
6.3 Enforcement
Violations may result in immediate suspension or termination, forfeiture of credits, a permanent ban, reporting to law enforcement, and recovery of our legal fees and damages from you.
7. Content Ownership and Licenses
You retain ownership of your inputs. By using MorphMe you transmit inputs to Decart AI for processing, governed by Decart's own terms. The transformed video output is produced by Decart Lucy 2 and is not a work of THE TOOLS HUB. We do not claim ownership of your inputs or outputs. Ownership and copyright in the output are governed by applicable law, Decart's own terms, and the rights of any person whose likeness appears — not warranted by us. Many jurisdictions do not recognize copyright in fully AI-generated output. You may not imply that THE TOOLS HUB, Decart, or any third-party service endorses content you produce.
8. User Representations and Warranties
You expressly represent and warrant to THE TOOLS HUB, as a condition of using MorphMe and as an inducement for us to provide the Service, that:
- you are at least 18 years of age and have the legal capacity to enter these Terms;
- the information you provide in your account is accurate, current, and complete;
- you own or have obtained all rights, licenses, permissions, and consents necessary for any input you supply to MorphMe, and for the likeness, voice, or identity of any real person your inputs direct the model to produce;
- your use of MorphMe and of the resulting output does not and will not violate any applicable law, nor the rights of any third party;
- you will disclose the AI-generated nature of the output where required by applicable law or platform policy;
- you are not listed on any sanctions or restricted-party list administered by the United Nations, the European Union, the United Kingdom, the United States, or Nigeria;
- your use of MorphMe is not intended to commit, facilitate, or conceal any criminal act or fraud;
- any content you generate you are solely responsible for, and you have no expectation that THE TOOLS HUB reviews, pre-screens, or moderates your content.
These representations and warranties are made each time you use MorphMe and are a material basis for these Terms.
9. Your Responsibility for Synthetic Content ("Deepfake" Liability)
This Section 9 is fundamental to these Terms and is not severable. If you cannot or will not agree to it, do not use MorphMe.
9.1 Acknowledgment
You acknowledge and agree that:
- MorphMe can generate realistic synthetic video depicting a person who is not you.
- You are solely responsible for every piece of content you create. THE TOOLS HUB does not pre-screen, monitor, or moderate user content in real time.
- You are solely responsible for obtaining any consent required from any real person whose likeness you produce.
- You are solely responsible for disclosing the AI-generated nature of content where required by law or platform rules.
- You are solely responsible for understanding the legality of your use in every jurisdiction where your content may be viewed.
9.2 No advice
Nothing in MorphMe or its documentation constitutes legal advice. If in doubt, consult a qualified lawyer before creating or publishing content.
9.3 Withdrawal of service
We may withhold the Service and preserve records if we receive a credible complaint, legal demand, or our own detection indicates a violation. Preservation may be mandated by law and may occur without prior notice to you.
9.4 Cooperation with authorities
We will cooperate with law enforcement, regulators, and courts in response to valid legal process. This may include disclosing your identity, transaction records, session metadata, and any other data we hold.
10. Copyright, Likeness, and Abuse Complaints
10.1 Where to report
If you believe content created or distributed using MorphMe infringes your copyright, violates your right of publicity, depicts you without consent, or otherwise violates Section 6, send a written complaint to:

10.2 What to include
- your full name and contact information;
- a description of the right you claim is being violated;
- the URL, account, or other identifying information for the offending content or user;
- a statement that you have a good-faith belief the use is unauthorized;
- a statement, under penalty of perjury where applicable, that the information is accurate and you are authorized to act;
- your physical or electronic signature.
10.3 Our response
We will acknowledge valid complaints within 14 days and investigate in good faith. Remedies we may take include account suspension, credit forfeiture, removal or blocking of offending material we host, cooperation with law enforcement, and preservation of records.
10.4 Counter-notice
A user whose content or account is affected may submit a counter-notice to the same email.
10.5 Repeat infringers
We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of third-party rights.
10.6 No safe harbor waiver
Where a safe-harbor or intermediary-liability framework applies in any jurisdiction (e.g. 17 USC §512 in the U.S., Article 17 of the EU Copyright Directive, §50 of the Nigerian Copyright Act 2022), we intend to comply with and benefit from it. This Section 10 does not waive any such safe harbor.
11. Service Availability
11.1 No uptime warranty
We aim to provide reliable service but do not warrant any specific level of availability, uptime, throughput, latency, or quality. We depend on third parties whose outages may affect MorphMe.
11.2 Scheduled and unscheduled downtime
We may perform maintenance, updates, and upgrades at any time, with or without notice.
11.3 Credits during outages
Credits are consumed only during active streaming. We do not provide service credits or refunds for downtime unless required by applicable law.
11.4 Beta features
Beta/preview/experimental features are provided entirely as-is with no warranty and may be changed or removed at any time.
11.5 Decart-related failures
You acknowledge that Decart processes the AI transformation. Any failure, error, latency, data use, loss, or misuse by Decart is Decart's responsibility. To the maximum extent permitted by law, your sole remedy for Decart-related claims is against Decart, not THE TOOLS HUB.
12. Disclaimers — AS IS, NO WARRANTY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- MorphMe is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied.
- We expressly disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, and completeness.
- We do not warrant that MorphMe will meet your requirements, be uninterrupted, timely, secure, or error-free.
- We do not warrant that output produced using MorphMe is lawful in your jurisdiction, is fit for any particular purpose, is free of bias, or will be acceptable to any platform or audience.
- We do not warrant the acts or omissions of any third-party service provider.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
13.1 Excluded damages
IN NO EVENT SHALL THE TOOLS HUB, ITS OFFICERS, DIRECTORS, OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, OR LICENSORS BE LIABLE FOR:
- any indirect, incidental, consequential, special, exemplary, or punitive damages;
- loss of profits, revenue, goodwill, business opportunity, or reputation;
- loss of data or business interruption;
- damages arising from your use or inability to use MorphMe;
- damages arising from any content you, we, or any third party create, transmit, or publish in connection with MorphMe;
- damages arising from any act or omission of a third-party service provider;
- damages arising from unauthorized access to your account;
- damages arising from any claim by a third party that your use violated their rights;
even if we have been advised of the possibility of such damages.
13.2 Liability cap
Our total cumulative liability to you, in contract, tort (including negligence), strict liability, or any other theory, shall not exceed the greater of:
- the amount you actually paid us in the three (3) months immediately preceding the event giving rise to the claim; or
- one hundred U.S. dollars (USD 100), or its NGN equivalent at the prevailing rate on the date the claim arose.
13.3 Mandatory non-waivable liabilities
Nothing in this Section 13 limits or excludes our liability for:
- fraud or fraudulent misrepresentation;
- death or personal injury caused by our negligence;
- gross negligence or willful misconduct;
- any liability that cannot lawfully be excluded under applicable consumer-protection or statutory law, including relevant provisions of the Federal Competition and Consumer Protection Act (FCCPA) 2018 in Nigeria.
13.4 Minimum permitted
If applicable law in your jurisdiction does not allow the full exclusion or limitation set out above, our liability is limited to the minimum extent permitted by that law.
13.5 Risk allocation
You acknowledge that the pricing of MorphMe reflects this allocation of risk and that without it we would not be able to offer the Service at the prices offered.
14. Indemnification
14.1 Your indemnification obligation
You agree to defend, indemnify, and hold harmless THE TOOLS HUB and our officers, directors, owners, employees, contractors, affiliates, and licensors from and against any claim, demand, action, proceeding, investigation, loss, damage, judgment, settlement, liability, cost, or expense (including reasonable legal fees and costs of regulatory defense) arising out of or relating to:
- your use or misuse of MorphMe;
- your breach of these Terms, your representations and warranties in Section 8, or any applicable law;
- content you create, transmit, publish, or distribute using MorphMe, including any claim by a third party that such content violates their rights;
- any "deepfake" or synthetic-media liability arising from your use, including NCII, impersonation, defamation, election interference, or fraud;
- any claim by any person whose likeness, voice, identity, or personal data appears in content you created, including a person who did not consent;
- any claim, investigation, subpoena, or enforcement action by any regulator, data protection authority, law enforcement agency, or court, including fines levied against us as a result of your use;
- any cost of criminal or regulatory defense arising from your conduct, whether or not you are ultimately convicted or sanctioned;
- any tax, levy, or duty that is your responsibility;
- any act or omission by anyone you allow to access your account.
14.2 Control of defense
We may assume the exclusive defense and control of any matter subject to indemnification. You may not settle any such matter without our prior written consent.
14.3 Survival
Your obligations under this Section 14 survive termination of your account and of these Terms.
15. Termination
15.1 By you
You may terminate your account at any time by emailing hello@morphmelive.com. Deletion requests are processed within 30 days. Unused credits on voluntary termination are not refunded except as required by law.
15.2 By us
We may suspend or terminate your account at any time, with or without notice, for breach, fraud, non-payment, discontinuance of the Service, or risk to us or our users.
15.3 Effect of termination
On termination, your right to use MorphMe ends immediately. Sections 5.7, 7, 8, 9, 10, 12, 13, 14, 16, and 17 survive.
16. Governing Law and Dispute Resolution
16.1 Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. The UN Convention on Contracts for the International Sale of Goods does not apply.
16.2 Exclusive jurisdiction
The courts of Cross River State, Nigeria have exclusive jurisdiction. You consent to the personal jurisdiction of those courts and waive any objection based on venue or inconvenient forum.
16.3 Informal resolution
Before filing any claim, you agree to contact us at hello@morphmelive.com and attempt in good faith to resolve the dispute informally for at least 30 days.
16.4 Class action waiver
To the maximum extent permitted by applicable law, any dispute must be brought in your individual capacity and not as part of any class, collective, consolidated, or representative proceeding.
16.5 Severability of the class action waiver
If, for a particular claim, the waiver in Section 16.4 is held unenforceable, that particular claim must nonetheless be brought in the forum specified in Section 16.2, individually and not as part of any class, collective, consolidated, or representative action, unless the governing law expressly requires otherwise. The remainder of these Terms continues in full force.
16.6 Consumer protections
Nothing in this Section limits any non-waivable statutory consumer protection you enjoy in your place of residence.
17. General Provisions
- Entire agreement: These Terms and the Privacy Policy are the entire agreement.
- No waiver: Failure to enforce any provision is not a waiver.
- Severability: If any provision is invalid, the rest remains in force.
- Assignment: You may not assign without our consent. We may assign to a successor.
- No agency: Nothing creates an agency, partnership, or employment relationship.
- Force majeure: We are not liable for failure or delay caused by events beyond our reasonable control.
- Notices: Notices to you go to the email on your account. Notices to us go to hello@morphmelive.com.
- Language: These Terms are drafted in English; the English version prevails over any translation.
- Changes: Material changes announced at least 14 days before effective date (shorter notice where legally required). Continued use constitutes acceptance.
